MedaKi Pharma Inc. (“MedaKi,” “we,” “us,” or “our”) reserves the right to update and change these Terms of Service by posting updates and changes to the Service. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.
MedaKi provides an online platform, accessible via web browser and installable as a progressive web app (PWA), that connects customers with local pharmacies for the purpose of ordering over-the-counter products, submitting prescriptions, and coordinating fulfillment. MedaKi acts as a technology platform connecting customers with independent pharmacies. All pharmaceutical services, including prescription verification, dispensing, and insurance adjudication, are provided by licensed pharmacies and pharmacists.
You must create an account to use certain features of the Service. You are responsible for:
You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement.
All orders placed through the Service are subject to acceptance by the participating pharmacy. Pharmacies reserve the right to refuse or cancel any order for any reason, including but not limited to:
Payment is processed securely through Stripe. We accept major credit cards (Visa, Mastercard, American Express), Google Pay, and Apple Pay. You agree to provide current, complete, and accurate payment information. Prices are subject to change without notice.
Refunds and returns are subject to each pharmacy's individual policies and applicable provincial regulations.
For prescription medications, you must provide a valid prescription from a licensed healthcare provider. Pharmacies will verify all prescriptions prior to dispensing medication.
You may upload prescription images (JPEG, PNG, or WebP format) through the Service, but final verification and acceptance is at the discretion of the licensed pharmacist. The pharmacist may contact you or your healthcare provider for clarification or additional information.
You are responsible for ensuring that your prescription is valid and up-to-date. Prescription medications will only be dispensed in accordance with applicable federal and provincial laws and regulations.
Your use of the Service is subject to MedaKi's Privacy Policy. Please review our Privacy Policy, which governs the Service and informs users of our data collection practices.
The Service and its original content, features, and functionality are owned by MedaKi Pharma Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without prior written consent from MedaKi.
In no event shall MedaKi Pharma Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
MedaKi acts solely as a technology platform. All pharmaceutical services are provided by independent licensed pharmacies. MedaKi is not responsible for the professional services provided by pharmacies or pharmacists.
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Ontario.
